Kronofogden (the Enforcement Authority)

Kronofogden (the Swedish Enforcement Authority) is the state agency that helps someone who has not been paid to collect a debt, and someone buried in debt to find a way out. It establishes debts through a payment order, collects them through attachment, and administers debt restructuring.

What Kronofogden actually does

Kronofogden has three main jobs. The first is the payment order (betalningsföreläggande): when someone has not been paid they can apply to have the agency formally establish the debt. The second is attachment (utmätning): actually collecting an established debt from your salary, your bank balances or your property. The third is debt restructuring (skuldsanering), the legal way out for someone so indebted that the debts can never be repaid in full. Kronofogden also handles evictions and is separate from Skatteverket, even though it collects unpaid tax on the state's behalf.

The default does not come from Kronofogden

This is what people most often get wrong. A betalningsanmärkning (payment default) is not created by Kronofogden. Kronofogden keeps public records of debts and decisions; it is the credit reference agencies, such as UC and Creditsafe, that pull the data from those records and register the default itself. For a private individual the default arises when the debt is established, meaning when Kronofogden has issued a ruling (utslag), not the moment a letter lands in the mailbox. Dispute the claim in time, or pay before the ruling gets that far, and no default need arise.

Step by step when a debt goes there

First the creditor usually sends a debt-collection notice (inkassokrav). If it is not paid, they can apply to Kronofogden for a payment order. The agency then sends the claim to you, and you can either pay, dispute it if you think it is wrong, or fail to respond. If you neither respond nor pay, Kronofogden issues a ruling (utslag) that establishes the debt. Only then can attachment happen: the agency can attach part of your salary each month, take money from your accounts, or sell property to cover the debt. Disputing in time, or paying early, is therefore the most important chance to stop the whole chain.

You always keep a living minimum

In a salary attachment Kronofogden never takes everything. You always keep a reserved amount (förbehållsbelopp), the living minimum (existensminimum), meant to cover food, clothing, hygiene and other essential living costs plus your actual housing cost. Kronofogden sets a standard amount (normalbelopp) each year and adds housing on top. Only what is left above the reserved amount can be attached. That is why it matters to answer Kronofogden's questions about your finances, so the amount is worked out correctly.
